§ 158-232. Scope of rules.
(a)
The rules in this article shall govern the general procedure for the institution, conduct, and determination of causes and proceedings before the council whenever it sits in its capacity as a public utility regulatory body, or franchise regulator, or both, including but not limited to cases initiated under section 158-131 et seq., standard filing requirements, cases arising under article IV, division 2 of this chapter, utility regulatory financing, investigating proceedings, and other utility and franchise matters. Whenever any provision of this article is in conflict with a provision of article I of this chapter, the provision of article II shall prevail over this article to the extent a conflict exists.
(b)
No provision or rule of this article shall relieve any utility company of any substantive obligation or duty imposed by ordinance, the home rule charter of the city, statute, or the constitution of the state.
(c)
The provisions of this article shall not restrict, condition, or impair the powers of the council, as the legislative branch of municipal government under the home rule charter of the city.
