§ 146-447. Filling of cut on paved and asphalt surfaced streets.

  • As soon as practical following the installation of the subsurface structure or structures, all trenches and pits on all paved and asphalt surfaced streets shall be carefully refilled in accordance with the standards and specifications established by the director of the department of public works. The backfill may be inspected by the director of the department of public works prior to repaving and, if the director determines that the refill is not satisfactory, he shall have the right to order the permittee to remove all of the filled material from the excavation and to have same refilled at the expense of the permittee. If such person fails to remove the unsatisfactory fill, the entire deposit shall be forfeited. Whenever caving occurs in the sidewall of any excavation, the pavement above such caving shall be removed and in no case shall any void or cavity be restored by side or lateral filling or tamping.
