§ 114-82. No assignment; domestic relations orders.
A.
The right of any person to an allowance or other benefit or accrual hereunder, including the return of member contributions, shall not be assigned or subject to execution, pledge, mortgage, garnishment or attachment; any attempt to assign, execute, pledge, mortgage, garnish or attach any such right, allowance, benefit accrual or return shall be void and of no effect.
B.
If the interest of a member hereunder is community property subject to division in accordance with R.S. 9:2801B:
1.
Any such division shall be evidenced by a court order reasonably acceptable to the trustees.
2.
No benefit shall be payable pursuant to such order until the member's retirement date.
3.
The trustees shall adopt procedures for the division and payment of benefits to the member's spouse pursuant to any such order.
4.
The system and the trustees shall have no liability for any payment made prior to the receipt and acceptance of any such order.
