§ 110-160. Location of carts.

  • (a)

    Cut flower vendors are prohibited from placing their pushcarts on the sidewalks in the city except those sidewalks where the paved part of the sidewalk is 12 or more feet wide. On such paved sidewalks which are 12 or more feet wide, pushcarts must be located as close to curbside as is possible for the convenient operation of their business but no closer than 18 inches from curbside and must be at least 30 feet behind a bus stop sign and at least five feet from the approach side of a crosswalk to an intersection. Cut flower dealers are prohibited from conducting business on any neutral ground or median strip of a divided street.

    (b)

    If at any time the outlet is deemed by the department of police to be interfering with either pedestrian or vehicular traffic or creating a disturbance, the outlet shall be removed immediately upon request by the department of police.

    (c)

    Cut flower vendors using the streets shall observe all traffic regulations for parking as contained in section 154-923 et seq. No cut flower vendor shall conduct his business within the same block as any licensed retail florist in the Vieux Carré nor within three blocks of any retail florist in the remainder of the city.

    (d)

    No cut flower vendor shall remain in any one place within any residential block or stop directly in front of any building used exclusively for residential occupancy. For purposes of this section a residential block is defined as a block along which a majority of the buildings with main entrances on the block contain solely residential occupancies.

    (e)

    No cut flower outlet shall be located or business transacted in Audubon Park or City Park.
