Article IV. DISCRIMINATION IN EMPLOYMENT, EMPLOYMENT AGENCIES, LABOR ORGANIZATION MEMBERSHIP, AND APPRENTICESHIP AND TRAINING PROGRAMS |
§ 86-25. Same—Apprenticeship and training programs.
It shall be a discriminatory practice for:
(1)
An employer, labor organization, or joint labor-management committee controlling apprenticeship or on-the-job or other training or retraining programs to discriminate against an individual because of race, creed, national origin or ancestry, color, religion, gender or sex, sexual orientation, gender identification, marital status, age, physical condition or disability in admission to or employment in a program established to provide apprenticeship or other training.
(2)
An employer, labor organization, employment agency, or joint labor-management committee controlling apprenticeship or other training or retraining programs, including on-the-job training programs, to print, publish, transmit by electronic computer based means, or circulate or cause to be printed, published, transmitted by electronic computer based means, or circulate any statement, advertisement, or publication relating to employment by such an employer, or membership in such organization or any classification or referral for employment by such labor organization, or relating to any classification or referral for employment by such an employment agency or relating to admission to or employment in any program established to provide apprenticeship or other training by such a joint labor-management committee indicating any preference, limitation, specification, or discrimination based on race, creed, national origin or ancestry, color, religion, gender or sex, sexual orientation, gender identification, marital status, age, physical condition or disability; except that such advertisement or publication may indicate preference, limitation, or specification based on religion, sex, sexual orientation, gender identification, or age when religion, sex, sexual orientation, gender identification, or age is a bona fide occupational qualification for employment.
