§ 66-407. Administrative hearing.

  • The owner or operator of any vehicle booted by a booting service business shall have the right to an administrative hearing held by the administrative adjudication bureau of public housing and environmental violations for a fee of $50.00 to determine if the booting of said vehicle was proper. The purpose of the hearing is to determine the validity of the boot and the charges imposed, and said hearing shall be conducted by a hearing officer of the administrative adjudication bureau of public housing and environmental violations. The owner or operator of said vehicle must make a written request for said hearing within ten calendar days of the date the motor vehicle. Should the hearing officer uphold the appeal of the person booted, the booting service business shall, within three business days, pay the person making the appeal the $50.00 appeal fee. The hearing officer shall require the booting service business within three business days to return all fees to the vehicle owner.
