§ 30-1013. Discretionary action by director.

  • If, after holding the hearing, the director of the department of health shall determine that the massage establishment was being operated as charged in the complaint or that the massage therapist has violated the provisions of this article, then the director shall either:

    (1)

    Suspend the license or permit for a period not to exceed 90 days if it is charged and proved that the licensee or permittee has been guilty of violating sections 30-1011(4), 30-1011(6), or 30-1011(7); or

    (2)

    Permanently revoke the license or permit if it is charged and proved that the licensee or permittee has been guilty of violating sections 30-1011(1), 30-1011(2), 30-1011(3), 30-1011(5), or 30-1011(8) or for any grounds that would warrant the denial of issuance of such license or permit in the first place.
