Division 10. RESIDENTIAL PERMIT PARKING PROGRAM |
§ 154-1141. Implementation; application for permit.
(a)
Once a residential permit parking zone or special permit parking zone has been approved by the city council, implementation on a particular street shall be contingent on the following criteria:
(1)
The street is primarily residential.
(2)
A majority of the households signed a petition seeking resident or special parking status for their block.
(3)
At least 75 percent of the legal on-street parking spaces must be occupied during the period proposed for parking restrictions, as determined by the parking administrator.
(b)
The chief traffic engineer or his designee shall install parking signs on the streets designated as the residential permit parking zone or special parking zone. The signs shall indicate the times, locations and conditions under which parking shall be by permit only.
(c)
The application fee pursuant to section 146-108 shall apply for both residential permit parking zone applications and special permit parking zone applications.
(d)
For residential permit parking zones, a permit for parking shall be issued only to residents within a designated residential permit parking zone upon application and payment of the applicable fee. A person is eligible to apply for a residential parking permit if they are a resident within a designated residential permit parking area and do not have adequate off-street parking available at their property, as determined by the parking administrator. Eligibility for a residential parking permit is ultimately at the discretion of the parking administrator. No more than one permit shall be issued to each vehicle for which application is made.
(e)
For residential permit parking zones, each application for a permit or renewal of a permit shall contain information sufficient to identify the applicant, provide proof of residency, identify the location of the resident's real property address or residence within the residential parking permit area, and identify the license number and provide proof of current registration of the resident motor vehicle for which the permit would be issued. The owner or operator of any motor vehicle applying for a residential parking permit shall have a valid state motor vehicle license except when the car is titled in a company's name and assigned to the resident for personal use. A letter from the company (on company stationery) must be presented identifying the resident, residential permit parking address, make and model and license plate number of the car along with the motor vehicle registration.
(f)
For residential permit parking zones, a resident shall provide proof of residency in the residential permit parking zone on a block designated for implementation at the time application is made. Adequate proof of residency may include: the resident's tax bill providing a "homestead exemption" for the municipal address of the eligible property or an executed, current lease or other agreement for the municipal address of the eligible property.
(g)
For residential permit parking zones, the application for a permit shall contain the name of the owner or operator of the motor vehicle; residential address, the make, model, registration and plate numbers of the motor vehicle; and the applicant's driver's license number. The motor vehicle registration and the driver's license of the applicant must be presented at the time of making such application in order to verify the contents thereof. The owner or operator of any motor vehicle applying for a residential parking permit shall have a valid state motor vehicle license.
(h)
For special permit parking zones, the applicable permits, application and evaluation criteria, and permit fee shall be dictated by council ordinance, as provided herein.
