§ 114-175. Reexamination; return to active membership.
A.
Once each year during the first five years following the commencement of an ordinary or accidental disability retirement allowance hereunder, and once each three years thereafter until a disabled member attains age 60, he shall be required to establish that he remains disabled in accordance with the rules and procedures established by the trustees. If he shall refuse reexamination, his accidental or ordinary disability retirement allowance shall be suspended and, upon the expiration of six months, such allowance shall be revoked.
B.
If, upon reexamination, a member is able to pursue gainful employment, his accidental or ordinary disability retirement allowance shall be discontinued upon his restoration to his former position or a substantially similar position with his employer.
C.
If a member receiving an ordinary or accidental disability retirement allowance again resumes employment with his employer, his allowance shall cease and he shall again be an active member of the system. Periods of creditable service before and after such disability shall be aggregated for purposes of determining his retirement benefit, provided that the period of such accidental or ordinary disability retirement shall not be taken into account.
