Article VI. BOOTING OF MOTOR VEHICLES ON PRIVATE PROPERTY AND PRIVATE PARKING AREA |
§ 66-401. Definitions.
For the purposes of this article, the following terms shall have the following meanings:
Boot or booting shall mean the act of placing on a parked motor vehicle a mechanical device that is designed to be attached to the wheel or tire or other part of such vehicle so as to prohibit its usual manner of movement.
Booting service business means the business by an individual, partnership, corporation, association, firm or other business entity of providing booting service as part of its operations.
City shall mean the City of New Orleans.
Motor vehicle shall mean an automobile, motorcycle, truck, trailer, semitrailer, or any truck, tractor and semitrailer combination, or any other vehicle operated on the streets of this city, used to transport persons or property and propelled by power other than muscular power.
Private parking area shall mean real estate, including all improvements, not owned or controlled by the city, State of Louisiana or United States of America that charges a fee for parking a motor vehicle. Private parking area shall include real estate leased by a governmental agency to a non-governmental entity.
Private property shall mean real estate, including all improvements, not owned or controlled by the city, State of Louisiana or United States of America near or contiguous: (1) to premises having one or more stores or establishments which is used for the parking of motor vehicles of customers or patrons or anyone who frequents such stores and business establishments, or (2) premises having one or more multiple dwellings which is used for the parking of motor vehicles for the occupants and guests of resident. Private property shall include real estate leased by a governmental agency to a non-governmental entity.
Vehicle owner shall mean the actual owner of the vehicle booted or any driver of the vehicle who reasonably appears to have authority to operate the vehicle.
