§ 66-249. Excavations or ponds to be filled or fenced.
(a)
Every owner, occupant or lessee of any lot located in a residential neighborhood which in the past has been or shall hereafter be used for a borrow pit for the excavation of soil or other materials thereby causing a pond or depression in which water accumulates and stands, shall cause the same to be filled with soil or other solid filling or waste material other than that described in section 66-285, or other offensive or deleterious matter, such filling to be brought to the level of the surrounding lots, or enclose such lot with a fence to be not less than six feet high, with at least three strands of barbed wire thereon, to prevent the entry of unauthorized persons on such premises, or lot.
(b)
Each day that such owner or occupant or lessee shall fail to comply with the requirements of this section shall constitute a separate offense and be punishable as provided by this Code.
