Chapter 62. EMERGENCY MEDICAL SERVICES |
Article I. PROVISION OF EMERGENCY MEDICAL SERVICES |
§ 62-3. Non-emergency and other service by private providers.
(a)
Permitted providers shall be the sole providers of all scheduled transports and non-emergency ambulance transportation originating in Orleans Parish, except as noted otherwise in this section and except when medically advisable to protect the patient's best interest, as determined by a physician.
(b)
All private providers shall be required to provide New Orleans EMS a listing of all contracts for scheduled transports, professional medical services, and emergency services on or before the first date of the calendar year to determine compliance with this chapter. Such listing shall be done on the form provided by New Orleans EMS. Any changes to contracts should be relayed to New Orleans EMS within 30 days. All information will remain strictly confidential and utilized only for emergency purposes.
(c)
Private providers shall be allowed to provide standby services at private community events. Standby services must be provided at the advanced life support level and shall ensure that any emergency requiring transportation to a hospital is by an advanced life support ambulance in the event of an emergency occurring on the site of the event. Private providers may do other standbys with coordination and notification of New Orleans EMS.
(d)
New Orleans EMS shall be the sole provider of professional medical services and standby services for:
(1)
All events taking place in Orleans Parish which are sponsored by or paid for by the City of New Orleans, its boards, agencies, and commissions.
(2)
All events which take place on municipally owned or operated property unless a private provider has a valid professional medical services contract for the provision of services at the event or venue.
(3)
All events which take place on public thoroughfares, streets, sidewalks, or rights-of-way, especially if such event causes closure of a street or requires supportive services from other city departments, agencies, boards or commissions, except in cases where New Orleans EMS is unable to provide for such services, as determined by the director of EMS or his or her designee or where the private provider has a valid professional medical services contract in effect with the venue or host.
(e)
If a private provider has a contract to provide professional medical services or emergency medical services, then the private provider must ensure an advanced life support ambulance is on site, thus providing adequate coverage and response time, whenever the building, facility or space is occupied for use or an event is taking place such that it is not normal occupancy during standard use. Adequate coverage shall include:
(1)
Call taking and dispatching of emergency medical resources.
(2)
ALS response in a time commensurate with the 911 system.
(3)
Appropriate additional response as should be necessary, including, but not limited to, other first responder or public safety agencies, such as the New Orleans Fire Department and New Orleans Police Department.
(f)
Exceptions to part (e) of this section shall include:
(1)
Dialysis centers.
(2)
Medical office complexes.
(3)
Doctor's offices.
(4)
Nursing homes.
In the cases of exceptions, coverage shall be guided by the contract in place.
