§ 54-258. Promotion of obscene devices.
(a)
It shall be unlawful for any person to promote with the intent to promote or wholesale promote with the intent to wholesale promote any obscene device.
(b)
The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:
Obscene device means a device, including an artificial penis or artificial vagina, designed or marketed as useful primarily for the stimulation of human genital organs.
Promote means to manufacture, issue, sell, provide, lease, mail, deliver, transfer, transmit, distribute, circulate, disseminate, present, exhibit, or advertise, or to offer or agree to do the same.
Wholesale promote means to manufacture, issue, sell, provide, lease, mail, deliver, transfer, transmit, distribute, circulate, disseminate, present, exhibit, or advertise, or to offer or agree to do the same for the purpose of resale.
(c)
This section does not apply to the possession or exhibition by a police officer, sheriff, deputy sheriff or other peace officer, or any person under their supervision or control, or any judge, jury or employee or agent of a court, or any attorney, or any member of a legislative body, municipal, state or federal, when such possession or exhibition thereof is connected with the prosecution or investigation of a violation or possible violation of this section or any other law.
(d)
Any person convicted of a violation of this section shall be punished by a fine of not more than $300.00 or imprisonment for not more than five months or both such fine and imprisonment.
