§ 54-155. Specific discharging of hazardous liquids into catch basins.

  • (a)

    It shall be unlawful for any person to discharge into the city's catch basins, drainage canals, or other elements of its public drainage system any hazardous liquids.

    (b)

    Discharging of hazardous liquids in the catch basins, drainage canals, or other elements of the public drainage system is the intentional depositing or pouring into any drainage canal, catch basin, drainage canal right-of-way, or public property impressed with a servitude for drainage, any hazardous liquid including but not limited to: cooking oil and fats, motor oil, antifreeze, solvents, truck and automotive fluids, paint, paint thinners, and gasoline.

    (c)

    Whoever violates this section shall be fined up to $5,000.00 for each violation. If a person found in violation of this section can demonstrate the inability to pay the penalty imposed, that person shall be ordered, in lieu of a monetary penalty, the performance of up to 100 hours of community service by picking up litter and trash on public roads, streets, catch basins and highways, and cleaning, cutting grass, removing weeds, litter and trash in public parks, playgrounds and cemeteries.
