§ 50-146. Ultimate disposition of paid costs.
The clerk of court shall deposit all costs under this article in a checking account in one of the banks of the city. Upon final determination of the cause on appeal, any judge sitting in the section of the court before which the cause was tried shall order the clerk of court:
(1)
If the judgment and sentence be reversed, to return to the appellant the amount theretofore paid by the appellant by check made payable to the order of the appellant upon surrender of a receipt properly endorsed by appellant; or
(2)
If the judgment and sentence be affirmed, any such judge shall order the clerk of court to issue a check for such sum payable to the department of finance, bureau of treasury, of the city, which amount so paid to the city shall be included on the daily financial report of the court.
