§ 50-144. Bill for costs and effect of failure to pay within five days.

  • The appellant or his attorney shall be sent a notice through the United States mail by the clerk of the municipal court to the effect that the record has been completed and enclosing a bill for the amount of cost due. The failure of the defendant to pay these costs within five judicial days from the mailing of such notice and bill shall operate as a dismissal of the appeal. Should this five-day period extend beyond the return date of the appeal, the return date shall be automatically extended to the end of this five-day period. The clerk of the municipal court shall not, under any circumstances, except upon the order of the proper appellate tribunal, release the record until all these costs have been paid in full.
