§ 50-86. All prosecutions to be by affidavit.

  • (a)

    All prosecutions in the municipal court and all prosecutions in the traffic court of the city shall be by affidavit or by bill of information.

    (b)

    The superintendent of police, the deputy superintendent of police, police supervisors, assistant supervisors of police, police captains, police lieutenants, police sergeants, police desk sergeants, the city attorney, deputy city attorneys and assistant city attorneys shall have the power to take oaths and verify affidavits filed by other members of the police department. The chief of security, captains, lieutenants, sergeants, airport safety supervisors, and airport safety officer II's of the Orleans Levee Board shall have the power to take oaths and verify affidavits filed by patrol officers or safety officers of the security department of airport safety section of the Orleans Levee Board. The director, the deputy director, bureau chiefs and environmental specialists II, III and IV of the department of health shall have the power to take oaths and verify affidavits filed by the other members of the department of health. The director, the deputy director, the secretary of the department, the chief building inspector and the zoning administrator of the department of safety and permits shall have the power to take oaths and verify affidavits filed by other members of the department of safety and permits. Housing authority project managers and housing authority administrative assistants shall have the power to take oaths and verify affidavits filed by other members of the housing authority of the city. The director, the deputy director and the chief building inspector of the Vieux Carré Commission shall have the power to take oaths and verify affidavits filed by other members of the Vieux Carré Commission. The director and the deputy director of the historic districts and landmarks commission shall have the power to take oaths and verify affidavits filed by other members of the historic districts and landmarks commission. The director, the deputy director, and the secretary of the department of utilities shall have the power to take oaths and verify affidavits filed by other members of the department of utilities.

    (c)

    The criminal sheriff, his chiefs, captains, lieutenants and sergeants shall have the power to take oaths and verify affidavits made by the appointed deputies of the criminal sheriff for offenses committed in their presence.

    (d)

    The director, the public parking administrator, administrative analyst assistants I, II, and III, administrative service supervisors, and parking control supervisor I and II of the streets department shall have the power to take oaths and verify affidavits made by parking control officers of the streets department.

    (e)

    The superintendent of fire, assistant superintendent of fire, the secretary of fire, the city fire marshal, assistant fire marshal and senior fire prevention inspectors of the fire department shall have the power to take oaths and verify affidavits filed by other members of the fire prevention division of the fire department.

    (f)

    The parish school board truancy center leader for each truancy center shall have the power to take oaths and verify affidavits made by truancy center social workers in connection with violations of sections relative to truancy.

    (g)

    The state department of wildlife and fisheries, the department's officers, including the secretary, deputy secretary, undersecretary and assistant secretaries shall have the power to take oaths and verify affidavits made by state wildlife and fisheries enforcement officers in connection with section 54-336 relative to the discharge of weapons.

    (h)

    The civil sheriff, his chiefs, majors, captains, lieutenants, and sergeants shall have the power to take oaths and verify affidavits filed or made by other employees and deputies of the civil sheriff.

    (i)

    The director of sanitation, and the director's deputy directors, shall have the power to take oaths and verify affidavits made by the sanitation rangers of the department of sanitation.

    (j)

    The superintendent of any college or university campus police department, deputy superintendent, police supervisor, assistant supervisor, captain, lieutenant, sergeant, and desk sergeant on the campus of a state supported or a private college or university who has peace officer standards and training (P.O.S.T.) certification and is on duty performing the police functions assigned by the college or university, shall have the power to take oaths and verify affidavits made by other members of such college or university campus police department.
