§ 30-1613. Enforcement.

  • (a)

    Failure of any person to comply with any of the provisions of this article, or of the terms and conditions of any permit granted, constitutes a violation.

    (b)

    When the department of health determines that a violation of this article, or the terms and conditions of any permit issued under this article, has occurred, it shall initiate suspension or revocation proceedings.

    (c)

    The department of health may also impose fines and/or hearing costs in addition to the suspension and revocation procedures established in this article.

    (d)

    The following are grounds for the suspension or revocation of the permits and/or the fining of the permittee:

    (1)

    Illegal disposal of any of the substances delineated in section 30-1636 will automatically result in revocation of a permit.

    (2)

    Lack of a covering for noncontainerized or open-bodied vehicles as required by section 30-1676.

    (3)

    Failure to maintain a leak-resistant body for enclosed or containerized vehicles as required by section 30-1676.

    (4)

    Failure to have a required manifest.

    (5)

    Transporting any of the substances delineated in section 30-1636 in violation of state law or this article.

    (6)

    Unsanitary conditions of vehicles.
