§ 30-986. Granting of permit.

  • Within 60 days of receipt of the application, the director of the department of health shall grant a massage therapist permit only if he finds that:

    (1)

    The applicant has passed the examination as required in section 30-982.

    (2)

    The required fee has been paid.

    (3)

    The application conforms in all respects to the provisions of this article.

    (4)

    The applicant has not knowingly made a material misstatement in the application for a permit.

    (5)

    The applicant has fully cooperated in the investigation of his application.

    (6)

    The applicant has not been convicted of a felony or pleaded guilty to or has currently pending against that person or forfeited bail or been convicted of violation of any law of any jurisdiction for prostitution, pandering, pimping, lewd conduct or sexual misconduct within five years of the application.

    (7)

    The applicant has furnished an acceptable medical certificate in compliance with the rules and regulations of the department of health.

    (8)

    The applicant has furnished to the director of the department of health an acceptable diploma or certificate of graduation from a school of massage therapy.

    (9)

    The applicant has not previously had a massage therapist permit or other similar permit or license denied or revoked for cause by this city or by any other state within two years of the date of the application.

    (10)

    The applicant is at least 18 years of age.
