§ 30-58. Purpose.

    purpose and intent of this Act is to provide a uniform and comprehensive set of regulations and standards for franchising, development, siting, installation, design, operation and maintenance of wireless facilities in the city's public right-of-way; to define the relationship between the grantee(s) and the grantor; to provide for the administration and supervision by the grantor of franchises throughout the term of the franchise. This Act provides standards necessary (1) for the preservation of the public right-of-way in the city for maximum benefit and use of the public; (2) to promote and protect public health and safety, community welfare, visual resources, and the aesthetic quality of the city consistent with the goals, objectives, and policies of the master plan; and (3) to provide for the orderly, managed, and efficient development of wireless facilities in accordance with the state and federal laws, rules, and regulations. These regulations are intended to prescribe clear and reasonable criteria to assess and process applications in a consistent and expeditious manner, while reducing the impacts associated with wireless facilities.
