§ 30-48. Service provisions.

  • (a)

    Services to be Provided.

    (1)

    Grantee shall not provide services regulated by the LPSC/FCC unless specifically authorized to provide such services.

    (2)

    Grantee shall not use its Wireline Telecommunications System or occupy the City's Rights-of-Way to provide cable television services or operate a cable television system as defined in the Cable Communications Policy Act of 1984 (47 U.S.C.A. § 521 et seq., as amended), or as recognized by the FCC without first obtaining a separate cable franchise from the Grantor, and Grantee shall not allow the use of its Telecommunications System by a cable system or operator that has not been granted a cable franchise by the Grantor.

    (b)

    Emergency Requirements. In case of Emergency or disaster, Grantee shall, upon request of the Grantor, cooperate with Grantor to the greatest extent reasonably feasible to render such assistance as may be required, which may include but shall not be limited to the usage of Grantee's Equipment and Plant, in accordance with the provision of the Emergency Assistance and Disaster Act, R.S. 29:722 et seq.
