§ 2-57. Subpoenas of city council; administration of oaths.

  • The city council, pursuant to section 3-124 of the Home Rule Charter, may issue subpoenas and subpoenas duces tecum directed to any person who may be found and served within the boundaries of the city, directing such person to appear and testify under oath or otherwise before and/or answer questions presented by the city council or its designated agent. Subpoenas shall be issued by the clerk of council upon the written request of the president of the council or by the president of the council upon the written request of any three councilmembers. A subpoena shall be served upon the person to whom the subpoena is directed by a commissioned police officer or by any other person of full legal age and capacity whom the president of the council signing such subpoena may designate. Any person appearing before the city council, or at such place designated by the council or its designated agent for the purpose of giving testimony or for the purpose of answering questions presented by the council or its designated agent, whether such appearance is voluntary or pursuant to a subpoena, may be required by the president of the council to swear or affirm that the testimony proffered or the answers to be given by such person are true, correct, and complete to the best of such person's information, knowledge, and belief, provided, however, that no person shall be compelled to give testimony, or answer questions, or produce documents or objects when such person lawfully and explicitly declines so to do upon grounds afforded by the Fifth Amendment of the Constitution of the United States of America and/or section 13 of article I of the Constitution of the State of Louisiana of 1974. Any oath or affirmation required by the city council shall be administered by a notary public duly commissioned in and for the parish.
