§ 26-234. Order to vacate—Contents.

  • At the hearing, if, in the opinion of the hearing officer the facts justify it, a premises is unsafe, unfit, and/or unlawful, an order to vacate shall be issued ordering that the premises be abated within a certain delay. The order shall provide the specific violations of this code that justify the finding that the premise is unsafe, unfit and/or unlawful. All occupants shall vacate within five days of the issuance of an order on the record at the hearing. The premises shall remain vacated until the code official determines that the violations creating the unsafe, unfit and/or unlawful premises have been abated. Upon this determination, the code official shall issue a letter of re-occupancy to the owner, and at that time the posting of the order to vacate, as provided in section 26-235, may be removed.
