§ 22-137. Aircraft equipped with loudspeaking devices, carrying banners or distributing printed matter.

  • (a)

    The term "aircraft" as used in this section shall mean any type of heavier-than-air or lighter-than-air aircraft now invented or yet to be invented, including, but not limited to airplanes, helicopters, balloons, etc.

    (b)

    No person shall make any flights by aircraft carrying banners, distributing circulars or other printed matter from the air, or operate a loud-speaking or sound-amplifying device within or over the corporate limits of the city, either on his own account or for hire or gratuitously, without first obtaining a permit to do so from the bureau of safety and permits, and the payment of a permit fee of $20.00 for each flight; provided, however, that the permits provided for in this section may be issued by the bureau of safety and permits for periods not longer than one month rather than for individual flights for a fee of $100.00 for the period.

    (c)

    Permits shall state the day and hours on which the flight is to be held. No permit shall be issued for the period beginning at 10:00 p.m. and ending at 10:00 a.m. on the following day.

    (d)

    Any person violating any of the provisions of this section shall, upon conviction thereof, be fined in a sum not exceeding $100.00 or by imprisonment for a term not exceeding 90 days, or both, for each violation.
