SubDivision III. Uses Not Requiring Coastal Use Permit |
§ 170-329. Blanket exemption.
No use or activity shall require a coastal use permit if:
(1)
The use or activity was lawfully commenced or established prior to the implementation of the coastal use permit process, as per the requirements of the zoning ordinance;
(2)
The secretary determines that a use within a fastland or above five feet mean sea level (MSL) does not have a direct or significant impact on coastal waters; or
(3)
The director or administrator determines one is not required pursuant to section 170-321.
