§ 170-321. Activities not requiring coastal use permits.
The following activities normally do not have direct and significant impacts on coastal waters; hence, a coastal use permit is not required:
(1)
Agricultural, forestry, and aquaculture activities on land consistently used in the past for such activities.
(2)
Hunting, fishing, trapping, where permitted.
(3)
Normal maintenance or repair of existing structures including emergency repairs of damage caused by accident, fire, or the elements, not to exceed 50 percent of the total value of the original structure, or as indicated in the floodplain performance requirements.
(4)
The preservation of scenic, historic, and scientific areas and wildlife preserves.
(5)
Construction and modification of navigational aids such as channel markers and anchor buoys.
(6)
Activities which do not have a direct and significant impact on coastal waters.
