Chapter 162. VEHICLES FOR HIRE |
Article III. CERTIFICATE OF PUBLIC NECESSITY AND CONVENIENCE |
Division 2. APPLICATION |
§ 162-190. Types for buses and limousines.
A certificate of public necessity and convenience will be issued for buses, limousines or other for-hire vehicles, except taxicabs, school buses, vehicles not operated on fixed rails, vehicles upon specified routes or between fixed terminals, vehicles under one or more of the following categories:
(1)
Group tours and special sightseeing. Includes general charter, group tours and special services of various types specifically identified by the terms of the CPNC (i.e., transportation for the handicapped, foreign language tours, etc.).
(2)
Per capita sightseeing. Includes all services defined under subsection (1) of this section, but in addition permits sightseeing tours to be sold on an individual or per capita basis.
(3)
Limousine service. Includes all vehicles defined pursuant to section 162-189 that are operating for prearranged hire pursuant to a limousine CPNC. Prearranged shall be arrangement directly with the livery service or through a third party (e.g., internet-based software application, guest service desk, or concierge desk), prior to pick-up, and evidenced by a properly completed trip sheet as provided in section 162-53. This provision shall not apply to wedding and funeral services. Limousine drivers shall be prohibited from picking up any passenger who attempts to hail a limousine from the public right-of-way. A violation of this provision shall subject the limousine driver to a fine of $500.00, and a driver's permit shall be subject to suspension or revocation for three or more offenses.
(4)
Airport contract limousines. Permits service from the airport to points within the city. The number of airport CPNC's to be issued will be determined jointly by the department of safety and permits and the aviation board considering the number of vehicles required to provide the base level of service specified in the ground transportation contract with the aviation board. Airport CPNC's will be valid for the life of the ground transportation contract and will revert to the city upon termination of that contract.
(5)
Airport delivery limousine service. Includes limousines, except airport contract limousines which may transport passengers to but not from the New Orleans International Airport.
(6)
Special charter. Public service commission and Interstate Commerce Commission certified bus companies are eligible for a special charter CPNC. Holders of a special charter CPNC may lease buses to tour planners and holders of per capita sightseeing CPNC's. ICC and PSC companies licensed under this section must be in full compliance with all relevant rules, regulations and requirements contained herein.
(7)
Per capita continuous loop, fixed-route sightseeing. Includes all services defined under subsections (1) and (2) of this section, but in addition permits sightseeing tours to operate on a fixed-route with a continuous loop allowing multiple stops and points of boarding and exiting.
