§ 162-189. Limousines.

  • (a)

    All applicants for certificates of public necessity and convenience for limousines shall serve and maintain a fidelity bond in the amount of $10,000.00, and evidence of such bond shall be provided upon application or renewal of such certificate.

    (b)

    Stretch limousines are luxurious for-hire vehicles that meet the manufacturer's specifications for luxury limousines designed with a capacity for six to nine passengers or less, including the driver, whereby all passengers are seated behind the driver, and no door exists at the rear of the vehicle that is designed to allow passenger entry or exit. Luxurious is considered a high-end, quality, spacious vehicle, as determined by the director. Generally, limousines may include luxury sedans, luxury Sports Utility Vehicles (SUV), luxury Sprinter Passenger Vans and luxury mini-buses, but in no event shall a luxury sedan, luxury SUV, luxury Sprinter Passenger Van or luxury mini-bus be considered a stretch limousine for purposes of initial CPNC issuance and maintenance thereof.

    (1)

    Luxury sedans shall mean any of the four-door-sedan-type automobiles with a seating capacity of not more than six, including the driver (e.g., - Lincoln Town Car). The model year of such luxury sedan limousine shall be no more than two years older than the calendar year of the initial application.

    (2)

    Luxury sport utility vehicles shall mean any of the four-door-SUV-type automobiles, with a seating capacity of not more than eight, including the driver (e.g., - Cadillac Escalade and Lincoln Navigator). The model year of such luxury SUV limousine shall be no more than two years older than the calendar year of the initial application.

    (3)

    Luxury sprinter vans shall have a seating capacity of not more than 12, including the driver (e.g., Mercedes-Benz Sprinter Van).

    (4)

    Luxury mini-bus shall have a seating capacity of greater than 16, including the driver.

    (c)

    The director of the department of safety and permits shall have the administrative authority to approve the type of limousine, and the colors shall be restricted to white, black, gray or dark blue.

    (d)

    (1)

    Delinquency penalty. A certificate of public necessity and convenience (CPNC) for limousines, sightseeing, airport shuttle, general charter, or special charter vehicles expires on June 30 of each year and must be renewed within the month following expiration (July) for a fee of $150.00. A CPNC renewal that is submitted in the month of August is subject to a delinquency penalty of $150.00 in addition to the renewal fee of $150.00. A CPNC renewal that is submitted in the month of September is subject to a delinquency penalty of $150.00 in addition to the renewal fee and the August delinquency penalty. A CPNC shall not be renewed after August 31; however, the director of the department of safety and permits (or his designee) at his discretion may make an exception for good cause shown by the CPNC holder. The request for an exception must be in writing before October 1 and if granted is subject to a delinquency penalty of $50.00 per month beginning in the month of October. This delinquency penalty shall be in addition to the fees and penalties outlined above.

    (2)

    Revocation of certificates of public necessity and convenience (CPNC). A certificate of public necessity and convenience (CPNC) that is not renewed by September 30 is suspended. A CPNC shall be revoked if a renewal is not submitted in July, August, or September, or within the extended time period granted by the director or the designee.

    (3)

    Extension for acquiring a vehicle and fee. Compliance with the requirement that a certificate of public necessity and convenience (CPNC) holder must have a vehicle in service may be extended for a period of time by the director of the department of safety and permits (or his designee) for good cause. The first extended time period is limited to a maximum of 90 days. Additional extensions may be granted but the aggregate of such extensions is limited to a maximum of one year. There is no fee for the first extension. Additional extensions are subject to a fee of $50.00 per month. If a vehicle is not placed into service within the extended time period granted by the director or the designee, the CPNC shall be revoked.
