§ 162-185. Factors for consideration.

  • In determining whether a CPNC should be issued, the director of the department of safety and permits shall consider the following:

    (1)

    Whether the requirements of the certificate of public necessity and convenience can be met and complied with only by the issuance of additional certificates of public necessity and convenience;

    (2)

    The resulting effect of an issuance upon the business of existing certificate holders and upon the existing agencies of mass transportation;

    (3)

    The effect upon traffic congestion and the safety of the public using the streets;

    (4)

    The effect upon working conditions, wages or other compensation paid to drivers of taxicabs or other motor vehicles being operated under existing CPNC's;

    (5)

    In the case of a new CPNC company, the applicant must establish the fact that the service to be provided is not and/or cannot be adequately provided by existing CPNC companies; or

    (6)

    Any other facts which the director may deem relevant.
