§ 162-184. Investigation.

Latest version.
  • (a)

The supervisor of the ground transportation bureau shall investigate all applicants for certificates of public necessity and convenience (CPNC) and the merits of each application. A written report of the findings and recommendations from the investigation shall be submitted to the director of the department of safety and permits. Not less than twice annually, at a time to be designated by the supervisor, such director or a duly designated agent subject to the director's final authority shall determine whether or not any CPNC will be granted or denied, provided such director shall not deny any application without a hearing being held thereon in accordance with R.S. 49:951 et seq., unless the granting of a CPNC would cause the number of taxicabs to exceed the limit specified in section 162-186. Existing CPNC holders and other interested parties may appear as intervenors in such hearings.

    (b)

In the event that applications exceed the number of CPNCs necessary to satisfy public necessity, the director of the department of safety and permits may utilize a lottery to determine the issuance of CPNCs to qualified and eligible applicants.
