§ 158-433. Order of procedure.

  • The presiding officer shall direct all parties to enter their appearances on the record. In all proceedings the petitioner, applicant or complainant, respectively, customarily shall open. Where several proceedings are heard on a consolidated record, the council or presiding officer shall designate who shall open and close. The council in all cases shall determine at what stage intervenors shall be permitted to offer evidence. After all parties have completed the presentation of their evidence and before the issuance of a report and recommended order, the council may call upon any party, the director of the department of utilities, or the staff or consultants of the council for further material or relevant evidence upon any issue, which, in the discretion of the council, may be presented at further public hearing after notice to all parties of record and proper publication of such hearing.
