§ 154-1090. Fixed fees and rental rates for use of curb space controlled by single/double space parking meters and multispace pay stations.

  • A charge of $30.00, or $15.00 for an event sponsored by a nonprofit, per diem in addition to a fixed fee of $45.00 shall be charged against all contractors, builders, and others requiring the temporary use of curb space controlled by single/double-space parking meter and/or multispace pay station or OPS services in order to facilitate work conducted by them in the immediate vicinity of the single/double space parking meters, multispace pay stations or OPS, except in the downtown area from the Pontchartrain Expressway to S. Claiborne Avenue to N. Claiborne Avenue to Elysian Fields to the River, including both sides of all streets listed, where the charge shall be $70.00, or $35.00 for an event sponsored by a nonprofit, per diem, in addition to the $45.00 fixed fee. Temporary use is defined as the time period posted on the single/double-space parking meter, multispace pay stations, or OPS. Temporary use of curb space controlled by single/double space parking meters or multispace pay stations or OPS shall not permit a user to disregard other regulations posted in the area. For purposes of this section, the term "nonprofit" shall mean an organization that is exempt from federal income tax under Section 501(c) of the Internal Revenue Code, is a Louisiana nonprofit corporation in good standing with an Employer Identification Number issued by the Internal Revenue Service, or is a school operated by the Orleans Parish School Board or Recovery School District. These fees shall be nonrefundable and shall not be waived.

    Upon receipt of an application and payment for such rentals the department of public works, or its representative, will appropriately display notice of such rental. In the case of a space(s) regulated by a multispace pay station, single/double space parking meters or OPS, the department of public works, or its representative, will appropriately display a notice of such rental on the physical barriers used to indicate the space(s) being rented. If the department of public works determines that the single/double space parking meter(s) or the multispace pay station(s), or installed OPS signs will hamper the work to be performed by the user or the possibility of damage to the single/double space parking meter, multispace pay station or OPS signs exists, then the department of public works, or its representative will remove the applicable single/double space parking meter(s), multispace pay station(s) and OPS signage and install "no parking" signs to indicate the space(s) have been rented. For this service a fee of $305.00 will be imposed, in addition to the per diem rates.

    Acceptance of an application for the use of curb space occupied by single/double-space parking meters, multispace pay stations or OPS signage shall be limited to a maximum of 90 days. If this period is not sufficient, the user must request renewal of the application at least five working days before the expiration date of the original application. If an extension is requested within less than five working days of the expiration of the original application, a new application must be initiated, and payment of the fixed fees of $45.00 and $305.00 will be required.
