§ 154-689. Disposition of parking citations.
(a)
The original parking citation shall be signed by the issuing officer, and shall be processed in accordance with this article and such other procedures as may be established and promulgated by the chief administrative officer.
(b)
A parking citation may be dismissed by a hearing examiner prior to an adjudication hearing only upon his written statement for good cause shown, which statement shall be made a part of the disposition record thereof.
(c)
Any person who has received a civil parking citation issued under the authority of this article and a parking ticket charging a criminal violation arising out of the same set of facts as the civil parking citation, may either:
(1)
Present the civil parking citation and the parking ticket charging a criminal violation to the city attorney or an assistant city attorney designated by him, who shall enter a nolle prosequi of the parking ticket charging a criminal violation; or
(2)
Present the civil parking citation and the parking ticket charging a criminal violation to the parking adjudication bureau which shall dismiss the civil parking citation.
(d)
Any person who has received a parking citation charging a criminal violation prior to May 19, 1986, may present such citation to the parking adjudication bureau and elect to contest such citation under the procedures set forth herein for the contesting of civil parking citations.
(e)
The public parking administrator shall be an ex-officio deputy clerk of the traffic court but only for the limited purpose of accepting custody of parking citations and civil parking citations filed under the authority of this chapter. Notwithstanding anything continued herein or in this chapter to the contrary, the public parking administrator shall not be an employee of the clerk of the traffic court entitled to any benefits of an employee in the classified or unclassified system of the city except as public parking administrator of the parking adjudication bureau.
