§ 154-1136. Definitions.

  • The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Motor vehicle means an auto, truck, motorcycle or other motor-driven form of transportation with a gross weight of less than 6,000 pounds.

    Primarily residential means 50 percent of the ground level space is residential property.

    Resident means an individual(s) domiciled and living in a residential property. For purposes of this definition domiciled means (1) a fixed residence in a residential permit parking zone, (2) which is the resident's primary and habitual residence (whereby the resident lives the majority of the year) and (3) the resident has the intention to remain there permanently or indefinitely.

    Resident motor vehicle means a registered motor vehicle owned or leased by a resident of the residential permit parking area and registered at his or her address within the residential parking permit area.

    Residential area means the contiguous or nearly contiguous area containing public streets and highways or parts thereof, the zoning of which is residential as provided in the Comprehensive Zoning Ordinance.

    Residential permit parking zone means a residential area designated as herein provided where resident motor vehicles displaying a valid permit as described herein shall be exempt from parking time restrictions established pursuant to this division.

    Residential property means a building or portion thereof, designed or used exclusively for residential occupancy, but not including trailers, hotels, motels, motor lodges, dormitories, boarding and lodging homes, or time share buildings.

    Residential property owner means the individual(s) that have at least a 51 percent ownership interest in a residential property as reflected on the property tax records for real property address. The residential property owner may or may not be a resident.

    Special area means a primarily residential contiguous or nearly contiguous area containing public streets and highways or parts thereof that necessitates specific parking regulations to accommodate the residents therein.

    Special permit parking zone means a special area ordained by the city council upon the recommendation of the director of the department of public works or their designee that provides specific permit requirements and applicable permit fees that supersede these specific requirements as provided herein.
