§ 14-159. Neighborhood petition.

  • (a)

    No permit to operate a teen club under this division shall be issued until the applicant for such permit has filed a petition signed by a minimum of 65 percent of the residents within a radius of 300 feet of the proposed location, indicating their approval of the establishment of a teen club.

    (b)

    The director of the department of finance shall adopt rules and regulations governing the procedure for securing the petition of consent provided for in this section. The rules shall provide that the circulator of the petition requesting a waiver shall subscribe to an affidavit attesting to the fact that the petition was circulated in accordance with the rules of the department and that the circulator personally witnessed the signatures on the petition and that the same were affixed to the petition by the person whose name appeared thereon.

    (c)

    An official petition form shall be prepared by the department and shall state in boldfaced type the official definition of a public dance hall, including its allowed hours of operation and the fact that the consent of 65 percent of the residents within 300 feet of the subject establishment is required. The petition form to be circulated for a public dance hall shall be the official form prepared by the department. No other form shall be used or will be accepted as a valid petition.
