§ 146-190. Property owners responsible for certain sidewalk defects.

In the case of existing facilities, when the installation of a sidewalk/banquette
is in the interest of public safety, or when a property owner creates or causes a
defect in an existing sidewalk/banquette, the director of the department of public
works may pave or repave such sidewalk/banquette. Upon the determination by a hearing
officer, pursuant to Chapter 6, Article II of this Code, that a property owner created
or caused a sidewalk defect adjacent to their property, the director of the department
of public works shall issue a statement of costs against the property owner for the
cost of such work as provided in section 6-38. Failure of the property owner to pay the costs shall result in a lien against the
property as provided in section 6-39.
