§ 122-142. Remedies in case of default of payment of fee.

If any payment of the switch track fee is not made at the date fixed by the ordinance
granting the permission for a switch track, then all subsequent installments accruing
under the terms thereof shall immediately, without demand or putting in default, become
payable or, at the option of the director of the department of public works, such
ordinance may be terminated and cancelled by a written notice to that effect addressed
to the grantee. Such cancellation shall not release any indebtedness accruing prior
to the date thereof or as long as the grantee remains and makes use of such utility
under such ordinance or the bond given under this division.
