§ 118-43. Fees for applications.
(a)
The city planning commission or any other agency designated by the city council shall collect in advance application fees according to the following schedule:
(1)
For all subdivisions, there shall be a base filing fee of $200.00 plus $25.00 per lot for each lot proposed.
a.
Any subdivision proposing the dedication of a street or portion thereof shall pay a minimum filing fee of $500.00.
b.
Applications submitting subdivisions under Policy E of subdivision regulations shall pay a minimum filing fee of $350.00.
c.
The applicant shall bear the cost of advertising and the cost of certified mailing for a subdivision requiring a public hearing.
d.
A $300.00 site plan review fee shall be required for any subdivision wherein site plans are required as part of the application procedure. This fee is in addition to any other applicable processing fees mentioned above.
e.
Applicants requesting reapproval or recertification of proposals previously approved or certified by the city planning commission shall be required to pay an additional $100.00 fee.
f.
Applicants requesting reconsideration of proposals previously acted upon by the planning commission are required to pay an additional $200.00 fee.
g.
All applicants appealing the planning commission's action on any subdivision to the city council are required to pay a fee of $300.00 for processing the appeal.
(2)
The party or parties proposing an amendment to the comprehensive zoning law of the city shall remit the applicable fee to the city planning commission before any action shall be taken on the request, in accordance with the comprehensive zoning law.
a.
The party or parties proposing an amendment shall be required to pay all advertising costs incurred in the processing of their application in addition to the applicable fee, regardless of the final disposition of the proposed change. Under no condition shall a fee or any part thereof be refunded after advertising commences or, in the case of administrative amendments, after such requests have been properly filed.
b.
The fee for a map change shall be as follows:
1.
All properties between zero and 4,999 square feet shall be $1,000.00.
2.
All properties between 5,000 and 24,999 square feet shall be $2,000.00.
3.
All properties between 25,000 and 74,999 square feet shall be $3,000.00.
4.
All properties over 75,000 square feet shall be $4,000.00.
c.
Notwithstanding the provisions of subsection (2)b., the following fees shall be applicable for conditional use applications:
1.
The gross square footage of the proposed structure being between zero and 4,999 square feet shall be $1,160.00.
2.
The gross square footage of the proposed structure being between 5,000 and 24,999 square feet shall be $2,320.00.
3.
The gross square footage of the proposed structure being between 25,000 and 74,999 square feet shall be $3,480.00.
4.
The gross square footage of the proposed structure being over 75,000 square feet shall be $4,640.00.
d.
Notwithstanding the provisions of subsection (2)b. and c., text amendments to the comprehensive zoning ordinance with regard to expanding or tailoring permitted or conditional uses under said Ordinance, a fee of $1,500.00 shall be imposed.
(3)
For processing restoration tax abatement applications a fee of $750.00 shall be imposed by the city planning commission or any other agency designated by the city council.
(4)
For reviewing appeals and/or plans involving designated zoning moratoriums or similar site plan reviews, a fee of $1,000.00 shall be imposed.
(5)
For reviewing appeals and/or plans involving urban corridors as provided in the comprehensive zoning ordinance, a fee of $225.00 shall be imposed for all compliant applicants with regards to urban corridor regulations and $500.00 for all noncompliant applications.
(6)
The party or parties proposing an amendment to Volume II, Chapter 14, the Land Use Plan of the Plan for the 21 st Century (Master Plan), or to the Future Land Use Maps (FLUM) contained therein, shall remit an application fee to the city planning commission before any action shall be taken on the request.
a.
The party or parties proposing an amendment shall be required to pay all advertising costs incurred in the processing of their application in addition to the applicable fee, regardless of the final disposition of the proposed change. Under no condition shall a fee or any part thereof be refunded after advertising commences.
b.
The fee for Master Plan FLUM amendments shall be as follows:
1.
All properties between zero and 4,999 square feet of lot area shall be $1,000.00.
2.
All properties between 5,000 and 24,999 square feet of lot area shall be $2,000.00.
3.
All properties between 25,000 and 74,999 square feet of lot area shall be $3,000.00.
4.
All properties 75,000 square feet of lot area or higher shall be $4,000.00.
c.
The fee for Master Plan text changes Volume II, Chapter 14, the Land Use Plan, shall be $1,500.00 per request, per topic. The executive director of the city planning commission shall determine the number of topics contained in a Land Use Plan text change application.
d.
Amendments initiated by the city are exempt from fees, unless initiated by council motion, whereby the council may require the payment of the fees provided herein.
