§ 114-189. Death after separation from service.

If a member dies after his separation from service and:
A.

Such member is not then eligible to receive a retirement allowance, the balance of his member account, if any, shall be distributed to his beneficiary in the form of a single-sum payment.

B.

Such member is then otherwise eligible for retirement and survived by a spouse, then in lieu of any benefit otherwise payable hereunder, his spouse shall receive the survivor's portion of the Option 2 annuity, determined as if such member had retired immediately before his death.
