§ 110-8. Specialty urban marketplace vendor permit.

  • (a)

    The operator of a specialty urban marketplace (as defined in the comprehensive zoning ordinance of the city) located within the central business district area who shall desire to allow the sale of food, novelties, cut flowers, handicrafts and other items from fixed locations and/or from pushcarts at outdoor locations on property owned, leased or controlled by, or licensed to, the specialty urban marketplace shall first apply for and obtain from the department of finance a specialty urban marketplace vendor permit. Only persons authorized by the permittee shall sell any items from property owned, leased or controlled by, or licensed to, a specialty urban marketplace which has a permit issued under the terms of this section.

    (b)

    The fee for a specialty urban marketplace vendor permit shall be $500.00 per year, to be paid by the permittee at the time of issuance and annually thereafter on the anniversary of its effective date. The permittee may allow persons authorized by the permittee to sell prepackaged food, novelties, cut flowers, handicrafts and other items from fixed locations and from pushcarts at outdoor locations on property owned, leased or controlled by, or licensed to, the permittee. The permittee shall maintain records of the sales activities of the persons authorized by the permittee to engage in such activity, and the permittee shall collect and remit to the department of finance the state and local sales taxes from all sales made pursuant to such permit. This provision shall not restrict the authority of the director of the department of finance to assess and collect sales and use taxes in accordance with section 150-441 et seq.
