§ 10-122. Fees.
Applicant for permits under this chapter shall pay for each permit on or before starting business according to the following schedule:
(1)
Retailers of beverages of low alcoholic content, whether to be sold in package or to be consumed on the premises for which the permit is issued, $135.00.
(2)
Wholesalers of beverages of low alcoholic content, $135.00.
(3)
Retailer of beverages of high alcoholic content, whether to be sold in package or to be consumed on the premises for which the permit is issued, $500.00.
(4)
Wholesalers of beverages of high content, $500.00.
(5)
Whenever the premises for which permits are issued to a retailer of beverages of low and high alcoholic content occupies a single building situated both in the parish and an adjoining parish, the respective permit fees as fixed in subsections (1) and (3) of this section shall be reduced to such amounts which, together with the permit fees paid to such adjoining parish, will equal the sum of $135.00 in the case of beverages of low alcoholic content, and $500.00 in the case of beverages of high alcoholic content; provided, however, that in no event shall the permit fees to be paid the city under such circumstances be less than 50 percent of the fees prescribed by subsections (1) and (3) of this section.

Retailers of sparkling or still wine with an alcoholic content less than 20 percent to be sold in package only, $300.00. The provisions of this subsection apply only where no other high or low alcoholic beverage permits are issued for the designated premises.

Manager's permit, $100.00 per year. Such permit shall be valid for one year from date of issuance and shall be nontransferable and valid in any retail alcoholic beverage outlet in the city.

Alcoholic beverage outlet application processing fee, $1,000.00 applied to new applications and renewal of applications. This fee will be imposed in the following manner. Effective on March 1, 2011, the application processing fee shall become $500.00. Effective on January 1, 2012, the application processing fee shall become $750.00. And beginning in 2013, the application processing fee shall become $1,000.00. The revenues generated by the fees established in this paragraph shall be allocated annually for processing of alcoholic beverage applications and the enforcement of laws and regulations concerning sale of alcoholic beverages. No additional increases to the application processing fee shall be imposed until a complete analysis of the city's cost of processing of alcoholic beverage applications and the enforcement of laws and regulations concerning sale of alcoholic beverages has been performed, and it is determined that an increase in the fee is justified.

Upon application to the bureau of revenue for a new alcoholic beverage outlet permit or for an alcoholic beverage permit that constitutes a change of ownership only (excluding yearly renewals of existing permits) in the Vieux Carré section of the city, any area of the city under the jurisdiction of the New Orleans Historic District Landmarks Commission (NO HDLC) or the Central Business District Historic District Landmarks Commission (CBD HDLC), or any area of the city that is subject to any moratorium on the issuance of alcoholic beverage permits at the time of application, the Vieux Carré Commission, Historic District Landmarks Commission, and/or the department of safety and permits shall charge a $50.00 nonrefundable processing fee on each such application received by the bureau of revenue and reviewed by the respective commission or department. Upon issuance of a valid alcoholic beverage outlet permit by the bureau of revenue, an additional $125.00 will be charged by the Vieux Carré Commission, Historic District Landmarks Commission and/or the department of safety and permits. All such fees will be collected by the bureau of revenue. In accordance with section 166-1, the Vieux Carré section of the city is hereby defined to comprise all that area within the city limits within the following boundaries: River, uptown side of Esplanade Avenue, the river side of North Rampart Street and the lower side of Iberville Street.

Not less than 26 percent of the revenues generated by the fees established in paragraphs (1) and (2) above shall be allocated annually for enforcement of laws and regulations concerning sale of alcoholic beverages; the mayor's recommended budget shall specifically identify the allocation.
