§ 10-12. Administrative and enforcement advisory committee.
An administrative and enforcement advisory committee shall be formed within 45 days from April 3, 1997. This committee shall serve as a liaison between the department of finance, the city council, the city alcoholic beverage control board, the department of police and the state office of alcoholic beverage control. The committee shall perform the following functions:
(1)
Assist the department of finance in the development and publication of a compliance handbook, and any necessary amendments thereto, outlining city, state and federal beverage alcohol laws, rules and regulations;
(2)
Assist and advise the city in educating beverage alcohol retailers, officers of the department of police and enforcement representatives of the department of finance regarding laws and regulations related to the proper operation of retail beverage alcohol establishments;
(3)
Review city efforts to enforce beverage alcohol laws and regulations, and advise officials charged with enforcing beverage alcohol control laws, rules and regulations;
(4)
Evaluate all aspects of the permitting, investigating, enforcing, prosecuting and penalizing of beverage alcohol retailers;
(5)
Develop a system to identify persons or entities selling beverage alcohol at retail without valid and current city and/or state beverage alcohol permits; and
(6)
Any other function related to the proper operation of retail beverage alcohol businesses, and the equitable and effective enforcement and regulation of such businesses.
a.
The committee shall request in writing any relevant information it may need from any city department or agency in order to accomplish its functions. Each department head shall promptly review each request and provide such information that is not otherwise confidential at no cost to the committee.
b.
The composition of the advisory committee shall consist of one representative from each of the following city departments or organizational groups:
1.
The department of law;
2.
The department of finance;
3.
The city planning commission;
4.
One representative to be submitted jointly by the Louisiana Association of Alcoholic Beverage Licensees, Inc., and the Louisiana Restaurant Association; and
5.
A citizen of the City of New Orleans.
c.
Appointments to the advisory committee shall be made by the respective department heads. With regard to number 5, above, the citizen may not have any affiliation with the alcoholic beverage industry. The mayor shall appoint a citizen from any nominations he may receive or, in the event he does not receive such nominations, he shall appoint any citizen of New Orleans. With regard to number 4. above, the appointment shall be made by the mayor from a minimum of two nominees.
d.
The advisory committee shall provide monthly written reports to the city council, the mayor and the city alcoholic beverage control board.
